PLURALISM OF THE SUBJECT OF LEGAL REGULATION OF INTERNATIONAL PRIVATE LAW

Abstract

Background. When disclosing the subject of legal regulation of private international law, both in Russian studies and in scientific sources abroad, distinct points of view are clearly observed. Along with the traditional vision of the subject of private international law, there are concepts that broaden or narrow the range of regulated relations. The aim of the research is to clarify what constitutes the subject of private international law within the framework of the civil concept.
Materials and methods. The realization of research tasks was achieved on the basis of an analysis of the main provisions of private international law, as set forth in the works of such authors as E. A. Abrosimova, L. P. Anufrieva, M. M. Boguslavsky, N. Yu. Yerpyleva, V. P. Zvekov, S. B. Krylov, I. S. Peretsky and others.
The methodological potential includes methods of comparative legal and historical legal analysis that allow one to compare the content and significance for the development of the theory and practice of regulating private international law.
Results. The articles consider the concept of the subject of legal regulation of private international law. So, the dominant position is occupied by the concept according to which the subject of private international law is formed from relations of civil, family and labor, complicated by a foreign element. Within the framework of the civil concept of private international law, it is asserted that its subject matter is only civil, that is, property and personal non-property. The essence of the lawenforcement concept of private international law is that, in general, there are three elements in international private law: jurisdiction, choice of law, process and foreign judgments.
